Terms of Service
Last Updated: September 13, 2026
These Terms of Service ("Terms") are an agreement between you and Event Foundry Inc ("Event Foundry", "we", "us", "our"), a United States software company. They govern your use of eventfoundry.com, our mobile and web applications (including Server Control for Minecraft) and the text messages we send you (together, the "Services").
By using the Services, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy explains how we handle your information and forms part of these Terms.
1. Eligibility and accounts
You must be at least 13 years old to hold an account. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian.
You are responsible for everything that happens under your account, for keeping your sign-in credentials and verification codes confidential, and for telling us promptly at support@eventfoundry.com if you believe your account has been accessed without your permission. You agree to give us accurate contact information and to keep it current.
2. Text Messages and One-Time Passcodes (SMS)
Program description
Event Foundry operates an account security messaging program. If you choose to verify a mobile number or enable two-factor authentication, we send you one-time passcodes (OTPs) and verification codes by SMS so you can confirm your number, sign in, or authorize a sensitive change to your account.
This is a transactional program. We do not send marketing, promotional, or advertising text messages, and we do not share mobile numbers with anyone for marketing purposes.
Your consent
You opt in by entering your own mobile number in our app or on our website at the point where you choose to verify a number or turn on two-factor authentication, and confirming the disclosure shown on that screen. By doing so, you agree to receive one-time verification codes by text message from Event Foundry at the number you provided, sent using an automatic telephone dialing system where applicable.
Consent to receive text messages is not a condition of creating an account, using the Services, or purchasing anything from us. You may only enroll a number you own or are authorized to use.
Program details
- Message frequency
- Varies. You receive a message only when you, or someone attempting to use your credentials, requests a code.
- Cost
- Message and data rates may apply, depending on your mobile plan. Event Foundry does not charge you for these messages.
- Getting help
- Reply HELP to any message, or email support@eventfoundry.com.
- Opting out
- Reply STOP to any message at any time. We will send a single confirmation and then stop sending texts to that number. You can also remove your number or turn off two-factor authentication in your account settings.
- Effect of opting out
- Opting out does not close your account, but we can no longer send passcodes to that number. You will need to verify by email instead, and phone-based two-factor authentication will be disabled.
- Availability
- The program supports United States mobile numbers on participating carriers. Delivery is not guaranteed on every carrier or device.
Carriers and delivery
Messages are delivered by our SMS provider and by your mobile carrier. Wireless carriers are not liable for delayed or undelivered messages. We are not responsible for delays, failures, or costs caused by your carrier, your device, your plan, or network conditions outside our control.
Keeping your number current
Mobile numbers are reassigned. If you stop using the number enrolled on your account, you must update or remove it promptly. You agree to indemnify us for messages sent to a number you enrolled but no longer control and did not update.
Keep your codes to yourself
One-time passcodes are confidential. Event Foundry will never ask you to read, forward, or share a passcode with anyone, including someone claiming to be our support team. If you receive a code you did not request, do not share it and change your password.
Privacy of SMS data
How we collect, use, store, and delete your mobile number is described in section 4 of our Privacy Policy.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
3. Acceptable use
You agree not to:
- Use the Services to break the law, infringe anyone's rights, or send spam, malware, or fraudulent content
- Attempt to access accounts, servers, or data that are not yours, or probe, scan, or test the security of our systems without written permission
- Interfere with, overload, or disrupt the Services, or circumvent rate limits, credit systems, subscription gating, or usage restrictions
- Reverse engineer, decompile, or attempt to extract source code from our applications, except where that restriction is unenforceable by law
- Resell, sublicense, or commercially redistribute the Services without our written agreement
- Enroll a mobile number you do not own or are not authorized to use, or use our passcode messages to harass anyone
- Use automated means to create accounts or request verification codes at volume
If you run a game server for other people, you are responsible for the conduct on that server and for meeting any obligations you have to the people who join it, as described in our Privacy Policy.
4. Client and contract work
Information on eventfoundry.com about our development, cloud, integration, and consulting services is for general information and is not an offer to contract. Any engagement is governed by a separate written agreement signed by both parties, such as a statement of work, master services agreement, or similar. If there is a conflict between that agreement and these Terms, that agreement controls for the engagement it covers.
5. Subscriptions, purchases, and credits
Some features require a subscription, a one-time purchase, or in-app credits. Purchases made through the Apple App Store or Google Play are processed by Apple or Google under their terms, and you must cancel a subscription through the store you bought it from. Deleting your account does not cancel it. Refunds are handled by the store according to its policy. Credits have no cash value, are not transferable, and expire or are forfeited on account deletion.
Prices, plans, and credit terms may change. Changes apply from your next billing period.
6. Intellectual property
The Services, including software, designs, text, and branding, belong to Event Foundry or our licensors and are protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You keep ownership of the content you create or upload, and you grant us the license we need to host, process, transmit, and back it up in order to provide the Services.
Minecraft is a trademark of Mojang AB. Event Foundry is not affiliated with, endorsed by, or sponsored by Mojang AB or Microsoft.
7. Third-party services
The Services rely on third parties, including Amazon Web Services, Twilio, Google, Apple, RevenueCat, and Sentry. We are not responsible for those services, and your use of them may be subject to their own terms.
8. Availability and changes
We may change, suspend, or discontinue any part of the Services, and we may impose limits on features or storage. We aim to give notice of material changes but cannot always do so, particularly for security or legal reasons. Cloud game servers are on-demand and may be interrupted by maintenance, capacity limits, or the behavior of the underlying infrastructure.
9. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that data, worlds, or messages will never be lost or delayed. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, Event Foundry and its officers, employees, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost worlds, or business interruption, arising out of or relating to the Services, even if we were advised such damages were possible.
Our total liability for all claims relating to the Services is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars ($100).
11. Indemnity
You agree to indemnify and hold harmless Event Foundry from claims, damages, losses, and reasonable legal fees arising from your use of the Services, your content, a server you operate, your breach of these Terms, or your violation of any law or third-party right.
12. Termination
You may stop using the Services and delete your account at any time from the Account tab in the app. We may suspend or terminate your access if you breach these Terms, if your use creates risk or legal exposure, or if we discontinue the Services. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) survive.
13. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. You and Event Foundry agree to the exclusive jurisdiction of the state and federal courts located in Colorado for any dispute that is not otherwise resolved, and each of us waives any objection to venue there. Nothing here prevents either party from seeking injunctive relief where appropriate, or you from bringing a qualifying claim in small claims court.
Before filing anything, please email support@eventfoundry.com first. Most issues are resolved faster that way.
14. Changes to these Terms
We may update these Terms. We will change the "Last Updated" date above, and for material changes we will give notice in the app, on this site, or by email before they take effect. Continuing to use the Services after a change means you accept the updated Terms.
15. General
These Terms, together with the Privacy Policy and any signed engagement agreement, are the entire agreement between us. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
